Génesis de la LOPPE

El presidente José López Portillo y su secretario de Gobernación, Jesús Reyes Heroles, convocaron en 1977 a una serie de audiencias para discutir propuestas sobre la reforma política

Numeralia:

The Pomodoro Technique

The Pomodoro Technique was developed in the late 1980s by Francesco Cirillo, an Italian university student. The idea behind the strategy is to divide work into digestible chunks, usually lasting 25 minutes each, and then take little rests in between.

  • You may train your mind to concentrate deeply and produce higher-quality work faster by dedicating a specific amount of time to a particular job. 
  • It helps users to more precisely estimate the amount of time needed for jobs
  • Tasks become less daunting when broken down into reasonable periods
  • Work on no more than one chore until the timer sounded
  • Breaking up work into smaller chunks and including pauses, the method helps people better utilize their cognitive resources and is in line with the brain's innate ability to focus.

Plan: Select a Task

Determining a precise job helps set the stage for a fruitful Pomodoro session. Develop a Successful Strategy. Spend a few minutes organizing the Pomodoro sessions. Start the day with a brief Pomodoro session. Divide Tasks: Break up big jobs into smaller, more doable parts. Begin with a picture of delight of finishing a task.

Set the Timer

Try out various durations to see what suits you best. Finding the perfect Pomodoro time is a personal quest. Shorter intervals could be better for routine, simple work, whereas longer Pomodoros might be needed for more complex undertakings in order to focus deeply and make progress. Gradually increase the Pomodoro length from shorter starts. Keep in mind that flexibility is essential. Prioritize activities during concentrated work times. Effort and focus are put on the most important activities.

Immerse Yourself

Give Your Whole Attention to the Task. Create a zone free from distractions. Reduce the amount of distractions. If random ideas or chores come to mind, immediately scribble them down on paper so you can deal with them later. Reduce Interruptions. Concentrate. Tip: Apply the 2-Minute Rule. Deal with a distraction right away if resolving it will take less than two minutes. If not, write it down at a later time.

The Flow Pomodoro. Going longer than the customary 25 minutes. Take longer breaks. One hour to 30 to 45 minutes so that you may delve deeper into challenging topics.

Kanban. To-Do, Doing, and Done tasks should be arranged on a Kanban board. Graphic method of tracking.

Take a Break

Pause. Mind-Rejuvenation. See what helps you focus and get back on track. 

Repeat or Reflect

Document. The Record phase begins once a set of Pomodoros is finished. Keep a Pomodoro notebook to show your productivity on a daily and weekly basis. Spend a few minutes at the end of each day thinking back on your Pomodoro sessions. Set aside time for a longer review every week. Examine your advancement. Evaluate your development.

Numeralia sobre huachicol fiscal

Para marzo de 2025, México solo cubrió el 40.1% de la demanda de gasolina y 61% de diésel en producción local, de acuerdo con los últimos datos de la Secretaría de Energía (SENER), analizados por PETROIntelligence.

El huachicol fiscal es la comercialización e importación de combustibles, principalmente gasolina y diésel, que se hace pasar por otro tipo de hidrocarburos para no pagar los impuestos correspondientes, principalmente el Impuesto Especial sobre Producción y Servicios (IEPS) y el de Valor Agregado (IVA).

El huachicol fiscal es una fuga de ingresos al fisco de hasta 525 mil millones de pesos anuales, según estimaciones del Sistema de Administración Tributaria (SAT).

Una de la formas más frecuentes del huachicol fiscal es la que se hace pasar por lubricante. En 2021, hubo un incremento de 79% en la importación de este tipo de sustancias sobre la demanda legítima, de acuerdo con un informe de la Secretaria de Hacienda en 2022.

En 2023, la Asociación Mexicana de Proveedores de Estaciones de Servicios (AMPES) compartió la estimación de la existencia de 22 mil puntos irregulares de autoconsumo, en comparación con las 13 mil 823 estaciones con permisos vigentes. Es decir, hay 1.6 puntos de venta ilegal por cada gasolinera regulada.

Pathways

The current education system Pathways consists of eleven differing paths suited to their needs and requirements, based around Public Speaking, Interpersonal Communication, Management, Strategic Leadership, and Confidence. Each path consists of 14 projects. Content consists of online and print materials, it being the first time in the organization’s history to provide modern technology in its programme. Content is available in English, and as of 2023, translations are available in 10 languages.

Pirámide de Kelsen en México

En el caso mexicano, la Pirámide de Kelsen se encuentra conformada por los siguientes niveles jerárquicos:
  1. La Constitución Política de los Estados Unidos Mexicanos. Ubicada en la cima, consta de tres partes fundamentales: el preámbulo, la parte dogmática y la parte orgánica. Junto a ella se encuentran los Tratados Internacionales en materia de Derechos Humanos que la nación haya suscrito.
  2. Las leyes federales. El segundo cuerpo lo ocupan el conjunto de leyes federales y los Tratados Internacionales no relacionados con los DDHH, como acuerdos comerciales, políticos, diplomáticos, etc. Dichas leyes rigen el conjunto de los estados mexicanos, aplican a toda la nación como conjunto.
  3. Las leyes estatales. Es decir, las Constituciones Estatales, las Leyes Estatales, las Leyes Orgánicas y las Normas Oficiales.
  4. Las leyes locales, que describen las facultades de los municipios, de ámbito puramente local y minoritario en comparación con los peldaños superiores de la pirámide. Se trata de las leyes “ordinarias”, de menor rango, pero que rigen las normas y los reglamentos del último peldaño.
  5. Las normas y reglamentos de base. En este último peldaño, el más amplio y el que sirve de base a la pirámide, se hallan los reglamentos, de carácter legislativo, así como las Normas Jurídicas Individualizadas, que son acciones jurídicas concretas, como los contratos o los testamentos, y que jamás pueden contravenir los peldaños superiores de la pirámide.

Pirámide de Kelsen

La Pirámide Kelseniana o la Pirámide de la jerarquía jurídica es la representación gráfica del sistema jurídico mediante una pirámide segmentada en diversos estratos o niveles. Representa una relación vertical entre las distintas normas jurídicas, como lo entendía el jurista y filósofo austríaco Hans Kelsen (1881-1973), desde la doctrina positivista.

Esta pirámide normativa surge de la idea de que toda norma jurídica obtiene su valor de una norma superior en jerarquía, de acuerdo a tres niveles jerárquicos distintos en los que Kelsen dividía su pirámide:

  1. El nivel fundamental. A la punta de la pirámide, donde se halla la Carta Magna, Constitución Nacional o el texto jurídico base del cual emanan todas las demás leyes y disposiciones. Es el texto clave sobre el cual no tiene jerarquía ninguna institución jurídica.
  2. El nivel legal. Ubicado en un peldaño intermedio y pudiendo dividirse en muchos subpeldaños, a lo largo de los cuales se ordenarán según jerarquía el conjunto de las leyes que hacen vida dentro del marco legal constitucional, desde las más (arriba) hasta las menos fundamentales (abajo).
  3. El nivel base. Al final de la pirámide, siendo el más ancho, pues contiene las sentencias de los organismos jurídicos, las cuales son mucho más abundantes en comparación con los peldaños anteriores, al mismo tiempo que menos fundamentales.

Toastmasters

Toastmasters International (TI) is a US-headquartered nonprofit educational organization that operates clubs worldwide for the purpose of helping people develop communication, public speaking, and leadership skills.

On 24 March 1905, Dr. Ralph C. Smedley, a 1903 graduate from Illinois Wesleyan University, who was also the educational director for Bloomington YMCA in Illinois, started a club in a dinner meeting, to train young boys and men in speech, to face an audience, and to express their thoughts. He envisioned it as a weekly social club, with training programs for short speeches, debates, and work in chairmanship. The members took turn to speak in 5 to 6 minutes while the elder men served as speech evaluators. George Sutton, General Secretary of YMCA, named the club "a Toastmasters Club". Smedley later noticed a significant improvement in his members' speeches and leadership abilities. When YMCA transferred Smedley to another city named Freeport in Illinois, he decided to expand his club to the new city.

The organization grew out of a single club founded by Smedley on October 22, 1924, at the YMCA in Santa Ana, California, United States. It originated as a set of classes with the aim of improving the communication skills of the young men under his charge. Toastmasters International was incorporated under Californian law on December 19, 1932. The first international chapter was established in Vancouver, Canada, in 1932. The organization began admitting women in 1973. Toastmasters International has more than 300,000 members in more than 14,000 clubs spanning 150 countries.

Mishandled firearms are extremely dangerous and can cause serious injury and death to the owner or other innocent people if they are not handled properly.

The four principles of firearm safety:

Apertura del signo de interrogación

Historia.

En el Tesoro de la lengua española se habla por primera vez del interrogante como “la señal que se pone en la escritura para que se entienda la cláusula interrogativa”

En el primer Diccionario de la Real Academia Española se dice que la interrogación se pone “al fin de la razón, no al principio” y también que "el signo se forma con una s al revés y añadiendo un punto debajo”.

En esta edición del Diccionario de la Real Academia Española se establece que se trata de “un signo ortográfico (¿?) que se pone al principio y al fin de la cláusula en que se hace pregunta”.

Razón.

En español no contamos con una estructura que indique que lo que sigue es una pregunta, así que necesitamos ambos signos para que ayuden al lector a entonar la frase de manera adecuada desde el principio. En inglés o alemán, por ejemplo, se invierte la estructura de la frase y el orden de las palabras para advertir, desde el comienzo de la frase, que es una pregunta. Ejemplo: You have cats, se distingue de: Do you have cats?. En español, ambas frases se entonarían de la misma manera, si no fuese por los signos de interrogación. Tienes gatos y ¿Tienes gatos?.

Cinco reglas para hacer ciencia

  1. No hay que estar ocupado todo el tiempo. Si estás muy ocupado, no eres creativo. Yo dejo espacios de tiempo para mí mismo.
  2. Cambiar de área de trabajo. Yo lo comparo con ser inmigrante. Vas a un país nuevo y ves que la gente hace las cosas de maneras diferentes. Entonces, adoptas las maneras que tienen sentido para ti, pero mantienes las que también tienen sentido para ti. Y las mezclas. 
  3. Rodéate de críticos. Especialmente cuando ganas el Premio Nobel, la gente te critica menos. Tengo colegas cercanos y amigos que me avisan cuando estoy equivocado. Cuando tienes éxito, empiezas a creer que lo sabes todo, pero no es así. Por eso necesitas a alguien que te diga, constantemente, que estás diciendo chorradas.
  4. No hacer caso de los consejos. A veces la gente hace caso de lo que dice una autoridad solo porque es una autoridad, pero tienes que comprobar si tiene sentido para ti. Si alguien te dice que hagas algo y no tiene sentido para ti, no lo hagas. 
  5. La regla número 5 es mi principal motivo para hacer ciencia: porque es divertida. Mi objetivo siempre ha sido hacer investigación impulsada por la curiosidad. Así que creo que la sociedad necesita aprender que la mejor manera de hacer ciencia, la mejor manera de encontrar futuras medicinas, es financiar la investigación impulsada por la curiosidad. Y las aplicaciones llegarán.

Numisma Sancti Benedicti

Es una medalla sacramental cristiana usada por católicos, anglicanos, metodistas y ortodoxos de occidente. 

El anverso presenta la figura de Benito de Nursia (Nursia, 480 - Montecassino, 547) sosteniendo en su mano derecha una cruz y en su mano izquierda el Libro de las Reglas, que él mismo escribió, con la oración de la buena muerte a su alrededor: Eius in obitu nostro præsentia muniamur!, que se traduce como A la hora de nuestra muerte seamos protegidos por su presencia. En el fondo de la imagen aparece una copa envenenada, de la cual, cuando el santo hizo sobre ella la señal de la cruz, salió una serpiente. Un enemigo celoso intentó envenenarlo dándole una hogaza de pan envenenada, mas al pretender comérsela se la llevó un cuervo (estos detalles aparecen en la medalla). En el fondo de la imagen aparece la frase Crux Sancti Patris Benedicti, que significa Cruz del Padre San Benito.

El reverso tiene la inscripción PAX, Paz, y las iniciales V.R.S. de la frase "Vade Retro Satana!", una fórmula católica de origen medieval que deriva de una frase que según el Evangelio de Marcos (8:33) fue pronunciada por Jesús de Nazaret. N.S.M.V., "Nunquam Suade Mihi Vana!", o sea, No me persuadas con cosas vanas. S.M.Q.L., "Sunt Mala Quae Libas", en español Son malas las cosas que ofreces. I.V.B., "Ipse Venena bibas", Que bebas tu propio veneno. Muestra además la cruz de san Benito con las siguientes iniciales: C.S.S.M.L., "Crux Sacra Sit Mihi Lux", es decir, Que la santa Cruz sea mi luz y N.D.S.M.D., "Non Draco Sit Mihi Dux", que se traduce como Que el dragón no sea mi lider. Además de las iniciales CSPB, que significan Crux Sancti Patris Benedicti.

La medalla de San Benito, conforme a la tradición cristiana, debe ser exorcizada y bendecida por un sacerdote católico benedictino.

The ballad of Paul O'Neill

On a blustery October day in 1987, a herd of prominent Wall Street investors and stock analysts gathered in the ballroom of a posh Manhattan hotel. They were there to meet the new CEO of the Aluminum Company of America—or Alcoa, as it was known—a corporation that, for nearly a century, had manufactured everything from the foil that wraps Hershey’s Kisses and the metal in Coca-Cola cans to the bolts that hold satellites together.

Alcoa’s founder had invented the process for smelting aluminum a century earlier, and since then the company had become one of the largest on earth. Many of the people in the audience had invested millions of dollars in Alcoa stock and had enjoyed a steady return. In the past year, however, investor grumblings started. Alcoa’s management had made misstep after misstep, unwisely trying to expand into new product lines while competitors stole customers and profits away.

So there had been a palpable sense of relief when Alcoa’s board announced it was time for new leadership. That relief, though, turned to unease when the choice was announced: the new CEO would be a former government bureaucrat named Paul O’Neill. Many on Wall Street had never heard of him. When Alcoa scheduled this meet and greet at the Manhattan ballroom, every major investor asked for an invitation.

A few minutes before noon, O’Neill took the stage. He was fiftyone years old, trim, and dressed in gray pinstripes and a red power tie. His hair was white and his posture military straight. He bounced up the steps and smiled warmly. He looked dignified, solid, confident. Like a chief executive. Then he opened his mouth.

“I want to talk to you about worker safety,” he said. “Every year, numerous Alcoa workers are injured so badly that they miss a day of work. Our safety record is better than the general American workforce, especially considering that our employees work with metals that are 1500 degrees and machines that can rip a man’s arm off. But it’s not good enough. I intend to make Alcoa the safest company in America. I intend to go for zero injuries.”

The audience was confused. These meetings usually followed a predictable script: A new CEO would start with an introduction, make a faux self-deprecating joke—something about how he slept his way through Harvard Business School—then promise to boost profits and lower costs. Next would come an excoriation of taxes, business regulations, and sometimes, with a fervor that suggested firsthand experience in divorce court, lawyers. Finally, the speech would end with a blizzard of buzzwords—“synergy,” “rightsizing,” and “co-opetition”—at which point everyone could return to their offices, reassured that capitalism was safe for another day.

O’Neill hadn’t said anything about profits. He didn’t mention taxes. There was no talk of “using alignment to achieve a win-win synergistic market advantage.” For all anyone in the audience knew, given his talk of worker safety, O’Neill might be pro-regulation. Or, worse, a Democrat. It was a terrifying prospect. “Now, before I go any further,” O’Neill said, “I want to point out the safety exits in this room.” He gestured to the rear of the ballroom. “There’s a couple of doors in the back, and in the unlikely event of a fire or other emergency, you should calmly walk out, go down the stairs to the lobby, and leave the building.”

Silence. The only noise was the hum of traffic through the windows. Safety? Fire exits? Was this a joke? One investor in the audience knew that O’Neill had been in Washington, D.C., during the sixties. Guy must have done a lot of drugs, he thought. Eventually, someone raised a hand and asked about inventories in the aerospace division. Another asked about the company’s capital ratios.

“I’m not certain you heard me,” O’Neill said. “If you want to understand how Alcoa is doing, you need to look at our workplace safety figures. If we bring our injury rates down, it won’t be because of cheerleading or the nonsense you sometimes hear from other CEOs. It will be because the individuals at this company have agreed to become part of something important: They’ve devoted themselves to creating a habit of excellence. Safety will be an indicator that we’re making progress in changing our habits across the entire institution. That’s how we should be judged.”

Enforcement - Sanctions

4.1 Sanctions in Administrative Law vs. Criminal Law

FATF Recommendation 35 requires that supervisory sanctions for breaches of AML/CFT requirements by institutions be effective, proportionate and dissuasive, and be applicable to both natural and legal persons.

4.2 Types and Characteristics of Administrative Sanctions

Sanctions can be imposed not only on the financial institution but on its personnel and members of the Board:

4.4 Publication of Sanctions

Financial sector supervisors may publicly disclose the non-compliant behavior of a financial institution. Public disclosure can be an effective way to contribute to greater transparency and accountability and may deter other financial institutions from engaging in similar behavior.

4.5 Judicial Review of Administrative Sanctions

A judicial review of an administrative sanction is a legal process in which a court reviews a decision made by a regulatory or administrative body regarding the imposition of sanctions. It is an important mechanism for ensuring that regulatory and administrative bodies act within their legal authority and that decisions are made in a fair, transparent, and accountable manner.

3.1 Licensing and Market Entry Requirements

FATF Recommendation 26: Regulation and supervision of financial institutions. ...Competent authorities or financial supervisors should take the necessary legal or regulatory measures to prevent criminals or their associates from holding, or being the beneficial owner of, a significant or controlling interest, or holding a management function in, a financial institution

Areas of assessment:

When in doubt, licensing process should not proceed.

3.2 Fitness and Propriety Assessments

The supervisory authority assesses whether incumbent and prospective board members are fit to occupy their position and whether their propriety is beyond doubt. A financial institution must be led by professionals who are competent to effectively manage all the risks to which the institution is exposed and who are of high integrity.

3.3 Corporate Governance and Risk Management Framework

corporate governance is defined as:

It helps define the way authority and responsibility are allocated and how corporate decisions are made.”

The BCBS has identified 13 principles for corporate governance in banks that include the following components:

  3. Policies and Procedures.
  4. Internal Controls. Reporting, escalation lines, separation of powers, etc.

Effective Risk-Based Supervision

2.1 Supervisory Mandate, Powers, and Responsibilities

The goal of AML/CFT supervision is to maintain the integrity of the financial system and protect it from illicit activities.

Supervisors should have the following powers:

  1. To monitor
  2. To conduct inspections
  3. To exact information
  4. To impose sanctions

Supervisors should have the following responsabilities:

  1. Define the framework
  2. Conduct risk assessments
  3. Monitor and supervise
  4. Provide guidance
  5. Coordinate with international actors
  6. Enforce the law

2.2 Access to Records

Supervisors should be authorized to compel production of, and have timely access to, any information relevant to effectively monitoring the management of ML/TF/PF risks:

  1. Types of records
  2. Timeframe
  3. Format of delivery
  4. Legal basis
Confidentiality requirements to access suspicious transactions reports should not apply to the supervisory authority.

2.3 Risk-based Supervisory Approach

A risk-based approach means that the level and intensity of supervisory activities are tailored to the risks posed by a financial institution or sector. Higher-risk institutions or sectors should be subject to more frequent and intensive supervision than lower-risk institutions or sectors.

Standards of Risk-based AML/CFT Supervision

The Financial Action Task Force (FATF) 40 Recommendations are measures which countries should implement to combat money laundering (ML), terrorist financing (TF), and proliferation financing (PF):

  3. Establish powers and responsabilities
  4. Enhance transparency and effectiveness
  5. Facilitate international cooperation
Evaluation:
  • Technical assessment. Is the framework in place?
  • Effectiveness assessment. Does the framework really work?
The Basel Committee on Banking Supervision (BCBS) is the global standard setter for the regulation of banks. It has 45 members from 28 jurisdictions, consisting of central banks and authorities with formal responsibility for the supervision of banking business. The BCBS has issued the 29 Core Principles for Effective Banking Supervision which are a set of high-level supervisory standards that guide the supervision of banks and banking systems:
  • Principles 01 - 13. What supervisors do themselves.
  • Principles 14 - 29. What supervisors expect banks to do.
These 29 principles also have:
  • Essential criteria: minimum baseline requirements for sound supervisory practices.
  • Additional criteria: suggested best practices that countries should aim for.
From an AML/CFT perspective, principle 29 is the most important:
  • Abuse of financial services. The supervigor determines that banks have adequate policies and processes, including strict customer due diligence (CDD) rules to promote high ethical and professional standards in the financial sector and prevent the bank from being used, intentionally or unintentionally, for criminal activities.
The International Association of Insurance Supervisors (IAIS) is the international standard setter for the supervision of the insurance sector. It comprises insurance supervisors and regulators from more than 200 jurisdictions. The IAIS Insurance Core Principles (ICP) seek to encourage high standards in member jurisdictions:
  1. Supervisory principles
  2. Market principles
  3. Infrastructure principles
From an AML/CFT perspective, principle 22 is the most important, it requires the supervisor to take effective measures to combat money laundering and terrorist financing, and also requires insurers to have appropriate risk-based policies and procedures in place to prevent, detect, and report.

The International Organization of Securities Commissions (IOSCO) is the global standard setter for the securities sector. Currently, it has more than 230 members. IOSCO’s Objectives set out 38 Principles of securities regulation:

Abstract.

Impact of Drug Traffic Organizations (DTOs) on the economy of mexican municipalities.

DTOs presence is associated with a decrease in:

    1. formal employment
    2. the number of establishments,
    3. average wages, and
    4. total wage mass.

through mechanisms such as:

    1. extortion, and
    2. creation of uncertainty.

Sectorial differences highlighted: 

    1. Sectors with high fixed costs and significan upfront capital investments are the most affected: Manufacturing, commerce and construction.
    2. Sector with greater mobility and lower entry barriers are less affected: Services.

Intro.

DTOs are complex organizations with highly defined command and control structures that produce, transport, and/or distribute large quantities of illicit drugs.

Beyond criminal violence, the mere presence of DTOs can put economic activity at risk and modify the decisions of multiple agents, such as business people and entrepeneurs, due to the extraction of rents and the creation of uncertainty.

Cartel influence is more pronounced when a single cartel arrives to a place than when we see an increase in the number of DTOs.

Conclusions.

  • Underscores the adverse economic impacts of organized crime.
  • There is a distinctions between mere presence and open violence.
  • Economic repercussions of DTOs presence are not uniform across industries.
  • The arrival of additional DTOs does not significantly exacerbate the adverse impacts.
  • Policies must address the particular vulnerabilities of the different sectors.
